This document sets out the privacy policy (“Privacy Policy”) of Lin Health, Inc. (“Lin Health,” “our,” “we,” or “us”). Lin Health offers a platform that analyzes user-inputted data to develop and return certain information to the user, including, but not limited to, predictors and predictive analyses, coaching opportunities, and recommendations for healthcare related products and services along with any website and mobile applications that we may maintain to use those services or provide or other information (collectively, the "Service"). Our Privacy Policy is designed to help you understand how we collect, use and share your personal information and to assist you in exercising the privacy rights that may be available to you. Any capitalized terms used and not defined in this Privacy Policy will have the same meaning as provided in the Terms of Service.

SCOPE

This Privacy Policy applies to personal information processed by us when you use the Service, including any mobile applications and by your access and use of https://www.lin.health/ or any other website that we might maintain.

In addition, please review our Terms of Service (“Terms”) which govern your use of the Services. By using the Service, you acknowledge that you have read and understood our Privacy Policy, accept our collection, use and disclosure of your information and data, and other activities, as described below, and agree to the terms of this Privacy Policy. If you do not agree to this Privacy Policy, you may not use the Service.

1. PERSONAL INFORMATION WE COLLECT

When you create an account, which is required in order to use our Service, or when you fill out a contact form, sign up to receive information from us, and/or allow us to contact you regarding the Service, you generally provide us with information that personally identifies you.

The categories of personal information we collect depend on your relationship with us and the requirements of applicable law.

Information You Provide to Us

Account Creation. When you create an account, we collect your name, phone number, address, email address, medical information, health related information, status of your mental health, your physicians’ names and contact information. Your phone number is used to generate one-time passcodes for login.

Your Communications with Us. We collect personal information from you such as email address, phone number, or mailing address when you request information about our Service, request customer or technical support, apply for a job, or otherwise communicate with us.

Surveys, Questionnaires, and Other Questions. We may contact you to participate in surveys and/or respond to questionnaires and other questions. If you choose to participate, your response may include personal and/or non-personal information depending on the nature of the survey or questions.

Social Media Content. We may offer forums, blogs, or social media pages. Any content you provide on these channels is “public” and is not subject to privacy protections.

Registration for Sweepstakes or Contests. We may run sweepstakes and contests. Contact information you provide may be used to reach you about promotional, marketing and business purposes (e.g. sweepstakes or contest), if permitted by law. In some jurisdictions, we are required to publicly share information of winners.

Information Collected Automatically

Automatic Data Collection. We may collect certain information automatically when you use the Service. Automatically collected information may include your Internet protocol (IP) address, user settings, MAC address, cookie identifiers, mobile carrier, mobile advertising and other unique identifiers, details about your browser, operating system or device, location information, Internet service provider, pages that you visit before, during and after using the Service, information about the links you click, and other information about how you use the Service. Information we collect may be associated with accounts and other devices.

In addition, we may automatically collect data regarding your use of our Service, such as the types of content you interact with and the frequency and duration of your activities. We may combine or aggregate your information with information that other people provide when they use our Service to produce aggregated, anonymized analytics about use of our Service.

Geolocation Information. When you use the Service, we may use location-based services to determine your location so that we can, for example, help find doctors in your area and provide estimated travel time to your appointments. You may opt out of location-based Services at any time by editing the setting on your device level.

Cookies, Pixel Tags/Web Beacons, Analytics Information. We, as well as third parties that provide content or other functionality on the Service, may use cookies, pixel tags, local storage, and other technologies (“Technologies”) to automatically collect information through the Service. Technologies are essentially small data files placed on your computer, tablet, mobile phone, or other devices that allow us and our partners to record certain pieces of information whenever you visit or interact with our Service.

Cookies are small text files placed in visitors’ computer browsers to store their preferences. Most browsers allow you to block and delete cookies. However, if you do that, the Service may not work properly.

Pixel Tags/Web Beacons. A pixel tag (also known as a web beacon) is a piece of code embedded in the Service that collects information about users’ engagement on that web page. The use of a pixel allows us to record, for example, that a user has visited a particular web page or clicked on a particular advertisement.

Analytics. We may use Google Analytics and other service providers to collect information regarding visitor behavior and visitor demographics on our Service. Information Collected from Other Sources

We may obtain information about you from other sources, including through your other health providers with whom you interact through the Service, or other third parties to supplement information provided by you. For example, if you access our Service through a third-party application, such as an app store, a third-party login service, or a social networking site, we may collect information about you from that third-party application that you have made public via your privacy settings. Information we collect through these services may include your name, your user identification number, your user name, medical information, health related information, status of your mental health, including your physicians’ names and contact information, location, gender, birth date, email, profile picture, and your contacts stored in that service. This supplemental information allows us to verify information that you have provided to us and to enhance our ability to provide you with current and future information about our business, products, and the Service.

2. HOW WE USE PERSONAL INFORMATION

We use personal information for a variety of business purposes, including to:

Provide our Service to you, such as:

Managing your information and accounts;
Providing access to certain areas, functionalities, and features of our Service;
Communicating with you about your account, activities on our Service and policy changes;
Undertaking activities to verify or maintain the quality or safety of a service;
Processing your financial information and other payment methods for products or Service purchased;
Providing advertising, analytics and marketing Service;
Providing Service on behalf of our customers and partners such as maintaining or servicing accounts, providing customer service, and verifying customer information; and

Provide you with additional content and Service, such as:

Emails, engagement via SMS, push notification, etc. with opportunities to engage and share information (e.g. reminders to record and share symptoms) or otherwise furnish you with customized materials about offers, products, and Service that may be of interest, including new content or Service, including those on behalf of third-parties we engage with;
Auditing relating to interactions, transactions and other compliance activities; and
Other purposes you consent to, are notified of, or are disclosed when you provide personal information.

We may further use identifiable or non-identifiable information about you for research or publication purposes. Such uses will be designed to improve healthcare quality, identify trends or patterns, or other purposes identified in the design of any such study. By using our services and providing your information to us, you consent to the use of your information for these purposes. Any use of information for these purposes will be done in accordance with applicable legal and/or regulatory requirements.

Use De-identified and Aggregated Information. We may use personal information and other data about you to create de-identified and aggregated information, such as de-identified demographic information, de-identified location information, information about the computer or device from which you access our Service, or other analyses we create. The de-identified information may be utilized for any business purposes allowable under applicable law, including potential development and refinement of machine learning, artificial intelligence, or similar systems.

Process Information on Behalf of Our Customer. Our customers may choose to use our Service to process certain data of their own, which may contain personal information. The data that we process through our Service is processed on behalf of our customers, and our privacy practices in those instances will be governed by the contracts that we have in place with the applicable customer, not this Privacy Policy.

How We Use Automatic Collection Technologies. We, as well as third parties that provide content or other functionality on the Service, may use Technologies to automatically collect information through the Service. While we do not currently use any of the Technologies, we may start use at any time. If we decide to use these Technologies, use may fall into the following general categories:

Operationally Necessary. This includes Technologies that allow you access to our Service, applications, and tools that are required to identify irregular site behavior, prevent fraudulent activity and improve security or that allow you to make use of our functionality;
Performance Related. We may use Technologies to assess the performance of our Service, including as part of our analytic practices to help us understand how our visitors use the Service;
Functionality Related. We may use Technologies that allow us to offer you enhanced functionality when accessing or using our Service. This may include identifying you when you sign into our Service or keeping track of your specified preferences, interests, or past items viewed;

Cross-Device Tracking. Your browsing activity may be tracked across different websites and different devices or apps. For example, we may attempt to match your activity on your mobile device with your activity on your laptop. To do this our technology partners may share data, such as your browsing patterns, geo-location and device identifiers, and will match the information of the browser and devices that appear to be used by the same person.

Notice Regarding Third Party Websites, Social Media Platforms and Application Programming Interfaces (APIs). The Service may contain links to other websites, and other websites may reference or link to our website or other Service. These other websites are not controlled by us. We encourage our users to read the privacy policies of each website and application with which they interact. We do not endorse, screen or approve and are not responsible for the privacy practices or content of such other websites or applications. Visiting these other websites or applications is at your own risk.

Our Service may include publicly accessible blogs, forums, social media pages, and private messaging features. By using such Service, you assume the risk that the personal information provided by you may be viewed and used by third parties for any number of purposes. In addition, social media buttons such as Twitter, LinkedIn and YouTube (that might include widgets such as the “share this” button or other interactive mini-programs) may be on our site. These features may collect your IP address, which page you are visiting on our site, and may set a cookie to enable the feature to function properly. These social media features are either hosted by a third party or hosted directly on our site. Your interactions with these features apart from your visit to our site are governed by the privacy policy of the company providing it.

We may use third party APIs as part of the functionality of our Service. APIs may allow third parties including analytics and advertising partners to collect personal information for various purposes including to provide analytics Service and content that is more relevant to you. 3. DISCLOSING PERSONAL INFORMATION TO THIRD PARTIES

We do not sell your personal information.

Service Providers. We may share any personal information we collect about you with our third-party service providers. The categories of service providers that we use may include: information technology and related service hosting; payment processors; customer service providers; and vendors to support the provision of the Service. These companies are only authorized to use your information as necessary to provide services to us and to assist with supporting our users.

Business Partners. We may provide personal information to business partners with whom we jointly offer products or the Service.

Affiliates. We may share personal information with our affiliated companies.

Disclosures to Protect Us or Others. We may access, preserve, and disclose any information we store associated with you to external parties if we, in good faith, believe doing so is required or appropriate to: comply with law enforcement or national security requests and legal process, such as a court order or subpoena; protect your, our or others’ rights, property, or safety; enforce our policies or contracts; collect amounts owed to us; or assist with an investigation or prosecution of suspected or actual illegal activity.

Disclosure in the Event of Merger, Sale, or Other Asset Transfers. If we are involved in a merger, acquisition, change of control, financing due diligence, purchase or sale of assets, or transition of service to another provider, then your information may be sold, transferred, or otherwise assigned as part of such a transaction, as permitted by law and/or contract. In the unlikely event of Lin Health's bankruptcy, insolvency, reorganization, receivership, or assignment for the benefit of creditors, or the application of laws or equitable principles affecting creditors' rights generally, we may not be able to control how personal information is treated, transferred, or used.

4. YOUR CHOICES

General

You have certain choices about your personal information. Where you have consented to the processing of your personal information, you may withdraw that consent at any time and prevent further processing by contacting us as described below. If you withdraw your consent or permission for us to use your personal information, then you will not be able to use the components of the Service that require your personal information. Even if you opt out, we may still collect and use non-personal information regarding your activities on our Service and for other legal purposes as described above.

Email Communications

If you receive an unwanted email from us, you can use the unsubscribe link we generally include at the bottom of one of our emails to opt out of receiving future emails or you may contact us at our Email Notice Address with “Opt-Out” as the subject line. You must include your full name, phone number, email address, and postal address in your request.

Note that you will continue to receive transaction-related emails regarding the Service or other products that you have requested. While your account is active, we may also send you certain non-promotional communications regarding us and our Service, and you will not be able to opt out of those communications (e.g., communications regarding the Service or updates to our Terms or this Privacy Policy).

Mobile Devices

We may send you push notifications and SMS through our mobile application. You may at any time opt out from receiving these types of communications by changing the settings on your mobile device. We may also collect location-based information if you use our mobile applications. You may opt out of this collection by changing the settings on your mobile device.

“Do Not Track”

Do Not Track (“DNT”) is a privacy preference that users can set in certain web browsers. Please note that we do not respond to or honor DNT signals or similar mechanisms transmitted by web browsers.

Cookies and Interest-Based Advertising

You may stop or restrict the placement of Technologies on your device or remove them by adjusting your preferences as your browser or device permits. The online advertising industry also provides websites from which you may opt out of receiving targeted ads from data partners and other advertising partners that participate in self-regulatory programs. You can access these and learn more about targeted advertising and consumer choice and privacy, at www.networkadvertising.org/managing/opt_out.asp, http://www.youronlinechoices.eu/, https://youradchoices.ca/choices/, and www.aboutads.info/choices/. To separately make choices for mobile apps on a mobile device, you can download DAA’s AppChoices application from your device’s app store. Alternatively, for some devices you may use your device’s platform controls in your settings to exercise choice.

Please note you must separately opt out in each browser and on each device. Advertisements on third party websites that contain the AdChoices link may have been directed to you based on information collected by advertising partners over time and across websites. These advertisements provide a mechanism to opt out of the advertising partners’ use of this information for interest-based advertising purposes.

Your Privacy Rights

In accordance with applicable law, you may have the right to request:

Access to/Portability of Personal Data about you consistent with legal requirements. In addition, you may have the right in some cases to receive or have your electronic Personal Data transferred to another party.
Correction of your personal information where it is inaccurate or incomplete. In some cases, we may provide self-service tools that enable you, or a person designated by you (e.g. caregiver, family member, etc.), to update your personal information or we may refer you to the controller of your personal information who is able to make the correction.
Deletion of your personal information, subject to certain exceptions prescribed by law.
Restriction of or object to processing of your personal information, including the right to opt in or opt out of the sale of your Personal Data to third parties, if applicable, where such requests are permitted by law.

Lin Health will honor these rights to the extent required by the Consumer Privacy Act. Any requests submitted must be verified by us before we will respond, and to enable this verification we may require you to provide us information confirming your identity, which may include any username or password information, and the personal information matching that which we have in our records. You may submit requests through an authorized agent given authority through a power of attorney form or other authorization acceptable to and verified by us. Lin Health will not discriminate against users based on their exercise of any of the rights under the Consumer Privacy Act, provided that Lin Health may charge different prices to users based on the value of the data they provide.

The types of personal information collected in the last 12 months and how this information has been shared are as described in this Privacy Policy.

General. You can exercise some of these rights by logging into your account. You can also contact us at support@lin.health or as otherwise set forth below to exercise any of your rights. We will process such requests in accordance with applicable laws. Please note that we may carry out deletion requests by de-identifying personal information. Additionally, we may retain information that is otherwise in de-identified and/or aggregated form, in archived or backup copies as required pursuant to records retention obligations, or as otherwise required by law. To protect your privacy, we may take steps to verify your identity before fulfilling your request.

5. DATA RETENTION

We store the personal information we receive as described in this Privacy Policy for as long as you use our Service or as necessary to fulfill the purpose(s) for which it was collected, provide our Service, resolve disputes, establish legal defenses, conduct audits, pursue legitimate business purposes, enforce our agreements, and comply with applicable laws.

6. SECURITY OF YOUR INFORMATION

We take steps to ensure that your information is treated securely and in accordance with this Privacy Policy. Unfortunately, no system is 100% secure, and we cannot ensure or warrant the security of any information you provide to us. To the fullest extent permitted by applicable law, we do not accept liability for unauthorized disclosure.

By using the Service or providing personal information to us, you agree that we may communicate with you electronically regarding security, privacy, and administrative issues relating to your use of the Service. If we learn of a security system’s breach, we may attempt to notify you by posting a notice on the Service, by mail, by sending an email to you, or using other contact information you provided to us.

You also have a significant role in protecting your information. Only you, or a person designated by you (e.g. caregiver, family member, etc.) should have access or be able to edit your personal information. As such, except as otherwise described herein, do not share your one-time passcodes with others.

7. CHILDREN’S INFORMATION

The Service is not directed to children under the age of 18 or other age as required by local law (“Approved Age”). We do not knowingly collect or maintain information acquired through our Website from any individual under the Approved Age. Any user under the Approved Age may not use or access our Website at any time or in any manner. If you learn that your child has provided us with personal information without your consent, you may contact us as set forth below. If Lin Health learns that personally identifiable information of persons less than the Approved Age has been collected from our site without verified parental consent, then Lin Health will delete such information and terminate the child’s account.

8. INTERNATIONAL VISITORS

The Service is hosted in the United States and intended for use solely by individuals in the United States. Lin Health does not currently direct its service outside of the United States and is not monitoring where you might be located. If you choose to use the Service from the European Union or other regions of the world with laws governing data collection and use that may differ from United States law, then please note that you are transferring your Personal Information outside of those regions to the United States for storage and processing. Unless specifically stated, Lin health does not direct the Services into any country outside of the United States.

9. GOVERNING LAW AND JURISDICTION

This Privacy Policy is governed by the laws of the State of Delaware, excluding the application of its conflicts of law rules. You agree that any controversy or claim arising out of or relating to this Privacy Policy, or the breach thereof, shall exclusively be brought in a state or federal court located in Denver, Colorado.

10. CHANGES TO OUR PRIVACY POLICY

We may revise this Privacy Policy from time to time at our sole discretion. If there are any material changes to this Privacy Policy, we will use reasonable efforts to notify you in advance. It is your responsibility to check this Privacy Policy for updates. You understand and agree that you will be deemed to have accepted any updated Privacy Policy if you, or a person designated by you (e.g. caregiver, family member, etc.), continue to use the Service after the new Privacy Policy takes effect.
